Official Promotion Rules for
Fire Equipment Drawing
These official rules govern
your participation in "Ziamatic Corp.'s Fire Equipment Credit Promotion" (the
"Promotion"),
sponsored by Ziamatic Corp.
("ZICO"), an industry leader in fire and safety services equipment.
1. Promotion
Dates. The Promotion begins on August 27, 2009 and ends on [August 31], 2010 at
[5:00 P].M. Eastern Standards Time.
2. Eligibility. NO PURCHASE NECESSARY TO ENTER OR
WIN. VOID WHERE PROHIBITED. The Promotion is subject to all
Federal, State, Local and
Municipal laws and regulations
and is void outside of the United States and wherever prohibited by law. Entry into the Promotion is open to any
person ("Entrant")
who, at the time of entry, is
an active member, employee, representative or firefighter in a public, private
or volunteer fire department or company
("Fire
Department") in any state of
the 50 United States of America or the District of Colombia. Entrants must be 18 years of age or
older to enter and to be eligible to
win. Employees, and their immediate family members and persons
living in the same households, of ZICO, its distributors, franchisees,
affiliates, subsidiaries,
their respective employees,
wholesalers, distributors, retailers, advertising and promotional agencies,
independent contractors, commissioned employees and
participating Promotion
sponsors are not eligible to win or enter. An Entrant may enter only once.
3. How
to Enter. An Entrant may enter the
Promotion by either: (a) submitting an application form, completed in full,
either in person to an authorized Promotion
representative of ZICO or via mail to ZICO at 10 West College Avenue,
P.O. Box 337, Yardley,
Pennsylvania 19067; or (b) by logging onto
www.ziamatic.com/[___] and
completing in full and submitting the online application (each a "Qualifying
Entry"). Entries will be accepted
no later than [5:00 P].M.
Eastern Standard Time on [August 31], 2010. ALL ENTRIES RECEIVED AFTER [5:00 P].M.
ON [AUGUST 31], 2010 WILL BE DEEMED INVALID,
DISQUALIFIED FROM THE
PROMOTION AND NULL, VOID AND OF NO EFFECT. By entering, Entrant acknowledges: compliance with these
Official
Promotion Rules (the "Official
Rules"), including eligibility requirements, the Entrant has entered the Promotion
to benefit the Fire Department for which the
Entrant is a member, employee,
representative or firefighter, and the decisions of ZICO and/or its agents,
acting as judges of the Promotion, as final. All entries in
the contest, qualifying or
otherwise, become the sole property of ZICO and will not be
returned to the Entrant or the
Fire Department for any reason.
4. The
Prize. The Fire Department
represented by the winning Qualifying Entry will receive a two thousand
($2,000.00) dollar credit (the "Prize") for the purchase
of ZICO products directly from ZICO or one of ZICO's authorized distributors. The total approximate
retail value of the Prize is two thousand ($2,000.00) dollars.
The Prize is non-transferable,
must be accepted as offered and there shall be no substitutions or cash
equivalents. Entrant acknowledges
and agrees that he/she
shall not be personally
entitled to any Prize, award or other compensation in connection with the
Promotion.
5. Drawing. A random draw will be held on [September
1, 2010] from all Qualifying Entries received and the first selected Qualifying
Entry will be deemed the winner; provided that before being declared the
winning Qualifying Entry, the Entrant who submitted the selected Qualifying
Entry and the Fire Department designated on such Qualifying Entry may be
required to sign a release form, confirming compliance with the rules of the
Promotion and acceptance of the Prize as offered, and releasing ZICO and its
respective directors, officers, employees and agents from any responsibility
for any injury, accident, loss, damages, misfortune or expense resulting from
the use or enjoyment of the Prize.
ZICO will notify the Entrant who submits the winning Qualifying Entry
and the Fire Department designated on such winning Qualifying Entry within
seventy-two (72) hours of the draw.
If the Entrant and/or the Fire Department designated on the winning
Qualifying Entry cannot or will not comply with these Official Rules, such
Entrant and/or the Fire Department should not be entered into the
Promotion. If the Entrant who
submits the winning Qualifying Entry or the Fire Department designated on the
winning Qualifying Entry is unwilling or unable to comply with the contest rules
within two (2) weeks of the draw, the selected Qualifying Entry will be
disqualified and another Qualifying Entry will be randomly drawn from the
remaining Qualifying Entries received.
By claiming the Prize, the Fire Department designated on the winning
Qualifying Entry waives the right to claim any cost of winning the Prize
including, without limitation, any and all costs of verification and
redemption, travel or postage to redeem the Prize and bears in full any
liability which might arise from redeeming or seeking to redeem the Prize,
including but not limited to any federal, state or local taxes which may or may
not be due on such Prize. The
Entrant who submits the winning Qualifying Entry and/or the Fire Department
designated on such winning Qualifying Entry shall contact ZICO to make final
arrangements. Some restrictions
may apply. The chances of winning
are dependent upon the total number of Qualifying Entries received.
6. Legal. The Entrant who submits the winning
Qualifying Entry agrees, except where prohibited, that ZICO may use Entrant's
name, picture, portrait, likeness, voice and statements made by Entrant (if
true) for advertising, trade or promotional purposes without compensation,
worldwide and in perpetuity, in all forms of media, now known or hereafter
devised, except where prohibited by law.
By entering, each Entrant consents to subscribing to an electronic
newsletter issued and distributed by ZICO, from time to time, to be received at
the electronic mail address provided by Entrant on the submitted entry and
Entrant authorizes ZICO to distribute an electronic newsletter to entrant at
such electronic mail address.
Entrant and ZICO acknowledge and agree that Entrant may discontinue such
subscription or authorization at any time and that no fees or penalties shall
be imposed by ZICO upon Entrant for discontinuation of such subscription or
authorization. By entering,
Entrant agrees that ZICO, its affiliates, partners, advertising and promotion
agencies and suppliers and all of their respective officers, directors,
employees, representatives and agents shall have no liability for, and shall be
held harmless for and against any damage, loss or injury that may arise in
whole or in part, directly or indirectly, from the acceptance, possession, use
or misuse of Prize (and any travel related hereto) or participation in this
Promotion. By accepting the Prize, the Fire Department designated on the
winning Qualifying Entry agrees, except where prohibited, that ZICO may use the
Fire Department's name, picture, portrait, likeness, and statements made on
behalf of the Fire Department (if true) for advertising, trade or promotional
purposes without compensation, worldwide and in perpetuity, in all forms of
media, now known or hereafter devised, except where prohibited by law. By accepting the Prize, the Fire
Department designated on the winning Qualifying Entry agrees that ZICO, its
affiliates, partners, advertising and promotion agencies and suppliers and all
of their respective officers, directors, employees, representatives and agents
shall have no liability for, and shall be held harmless for and against any
damage, loss or injury that may arise in whole or in part, directly or
indirectly, from the acceptance, possession, use or misuse of the Prize (and
any travel related hereto) or participation in this Promotion. By accepting the Prize, the Fire
Department designated on the winning Qualifying Entry agrees to be bound by the
terms and conditions of these Official Rules. ZICO makes no warranty, representation or guarantee, express
or implied, in fact or in law, relative to the use of Prize awarded. Any
litigation respecting the awarding of the Prize may only be submitted to
arbitration at the Court of Common Pleas for the County of Bucks only for the
purpose of helping the parties reach a settlement. In the event that the
Promotion is cancelled, terminated, modified or suspended, notification of such
event will be posted by ZICO at www.ziamatic.com. Any attempt by any Entrant, Fire Department or any other
individual to deliberately damage any website (including www.ziamatic.com) or
undermine the legitimate operation of the Promotion is a violation of criminal
and civil laws and should such an attempt be made, ZICO reserves the right to
seek any and all damages and other remedies from such person(s) to the fullest
extent permitted by law. All
federal, state or local taxes on the Prize, if any, are the sole responsibility
of the winning Fire Department. No
taxes, including, but not limited to, federal, state, or local income taxes,
shall be paid by ZICO. Taxes are
subject to change at any time.
7. Winners. For the name of the winning Entrant
and/or Fire Department designated on the winning Qualifying Entry (available
within 14 days of drawing), send a self-addressed, stamped envelope to: Ziamatic
